1 TERMS OF SALE

Definitions

1.1 We, us, our mean Seva Yoga.

1.2 You and your mean the purchaser of goods, audio or video content from Seva Yoga.

1.3 This is a contract between us and you.

1.4 We may change these Terms from time to time. Any changes will come into effect when the updated terms and conditions are posted to the Website. These terms are important and you should ensure that you read them carefully before using the remainder of the website. You can contact us via email here.

1.5 The information provided on this site and in our courses and seminars is not medical nor health advice, we do not conduct a medical practice and we do not make personal recommendations in our courses and seminars.

1.6 Testimonials published by us are independent and genuine. However, they do not represent a guarantee or warranty of similar results.

2 Enrollment Agreement

2.1 By accepting these terms You to pay the Course fees for the Course using the payment method selected on the checkout page.

2.2 You accept that you are required to pay the full amount of the course fees even if you does not complete the Course. If you are under the age of 18, your parent/guardian is responsible for the payment of the Course Fees. The approximate duration of the Course is stated on the course page in the course FAQs. Course commencement is the date upon which we receive your fees in full. You are unable to graduate from the course until course fees have been paid in full.

2.3 “Lifetime Access” means ongoing and complete access to the course for the life of the program, not for your life or the life of Supriya Roy. This is ongoing access at no additional charge until the course is no longer offered, at which time all members will be given at least 6 months notice before the program is closed. Any future closure of the program or community in the future does not affect the refund policy and does not entitle members to any form of refund.

3 Contract

3.1 When you purchase audio or video content from us, we grant you a licence (which is limited, revocable, non-exclusive, non-transferable) to listen to, download or stream such content to your computer and/or other device(s) solely for your personal, non-commercial use. You agree to not otherwise copy, reproduce, distribute or use the content other than as set out in this contract. You must not sell, transfer, lease, modify, distribute or publicly perform the content in any manner and you must not exploit it commercially. You agree to not tamper with the content or create any derivative works therefrom.

3.2 We may terminate your license to use any purchased products if you breach this contract.

4 Payment

4.1 You may request to make payment by instalments. If you and we agree that you may make payments by instalments you must pay all instalments on or before each due date.

4.2 The due date for each instalment is 30 days after purchase and payment of the first instalment, and 30 days after each previous instalment.

4.3 All goods sold by us are charged in AUD dollars. If you are located in Australia you will be charged Australian Goods and Services Tax.

5 Refunds & exchange

5.1 Voluntary refunds:

(a) If you work through the first few modules of a course are not totally happy with it, then we will refund your money. Seva Yoga has a 14 day money back guarantee and refund period.

I believe in my courses and former students have experienced growth, development and results from investing in my programs. This type of progress requires that you follow the course and do the work. You must demonstrate that you have participated in the Course by accessing course content and/or joining the Facebook community before requesting a cancellation of your course membership and refund. We may request the submission of completed worksheets, activities and exercises in considering your refund request. A change of mind does not constitute a valid reason for cancellation and request for refund. In considering your refund we may also charge an admin fee at our discretion.

Requests for refunds must be made in writing via email within the defined refund period as listed above in section 5.1 (a).

(b) If you receive your money back you must delete every copy of the product and materials that you have downloaded as well as copies you have placed on other devices or media.

(c) being removed or banned from the Facebook group does not entitle you to a refund of your course enrolment fee.

5.2 Your refund will be paid in the currency in which it was received by us. If you paid in a currency other than Australian dollars, you may be liable for the costs of exchange.

6 Confidentiality & Privacy

6.1 You agree to our Confidentiality and Privacy Policy

6.2 We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our team or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.

6.3 We will only disclose information that we have about you:

  1. to the extent specifically required by law; or
  2. for the purposes of this agreement (including disclosing information in connection with any query or claim)
  3. information provided by you is considered confidential and will not be divulged to any third party, nor will it be sold.

6.4    Upon enrolment into the course, we may use the content from your emails in our marketing materials and on our website testimonials page, as well as send you a monthly newsletter. Your identity will never be revealed, however we will use your first name and initials. Please be assured that we respect your privacy and only comments related to course outcomes and student experiences will be mentioned.

This Privacy Policy governs your access to and use of www.sevayoga.com, including any content, functionality and services offered on or through www.sevayoga.com.au (the “Website”), whether as a guest or a registered user.

When accessing the Website, we will learn certain information about you, both automatically and through voluntary actions you may take, during your visit. This policy applies to information we collect on the Website and in email, text, or other electronic messages between you and the Website.

Please read the Privacy Policy carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Use when this option is made available to you, you accept and agree to be bound and abide by the Privacy Policy. If you do not want to agree to the Privacy Policy, you must not access or use the Website.

6.5 Children Under The Age Of 13

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or on or through any of its features/register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.

If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at info@sevayoga.com.au

6.6 Information We Collect About You

When you access the Website, the Company will learn certain information about you during your visit.

Information You Provide To Us. The Website provides various places for users to provide information. We collect information that users provide by filling out forms on the Website, communicating with us via contact forms, responding to surveys, search queries on our search feature, providing comments or other feedback, and providing information when ordering a product or service via the Website.

We use information you provide to us to deliver the requested product and/or service, to improve our overall performance, and to provide you with offers, promotions, and information.

Information We Collect Through Automatic Data Collection Technology. As you navigate through our Website, we may use automatic data collection technologies including Google Analytics to collect certain information about your equipment, browsing actions, and patterns. This will generally include information about your location, your traffic pattern through our website, and any communications between your computer and our Website.  Among other things, we will collect data about the type of computer you use, your Internet connection, your IP address, your operating system, and your browser type.

The information we collect automatically is used for statistical data and will not include personal information. We use this data to improve our Website and our service offerings. To the extent that you voluntarily provide personal information to us, our systems will associate the automatically collected information with your personal information.

7 Code of Practice

7.1 Seva Yoga has responsibilities to you as a student to provide you with a quality of service that will assist you as much as possible in attaining your professional development certificate. We undertake to abide by all our policies and procedures.

Seva Yoga agrees to:

  1. Provide a tax invoice;
  2. Provide login details to access the online Course Materials (or alternative access) and mark assessments and provide feedback where applicable on submitted assessment tasks;
  3. Provide unlimited tutor support via email and throughout the enrolment;
  4. Issue a Certificate upon satisfactory completion of the course (if applicable). 5. We will provide clients with the results of their assessment within 7-14 days of assessment submission/completion. Certificates (electronic) will be issued within 7 days after marking a students’ final assessment, with optional hard copies available for purchase within Australia. International students will receive an electronic copy of their certificate only.

 

8 Jurisdiction

8.1 These Terms are governed by and to be construed in accordance with the laws of New South Wales, and the Commonwealth of Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New South Wales.

8.2 If any of these Terms is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms which will continue in full force and effect.

9 Events

9.1 Cancellation policy: Tickets are non-refundable but completely transferable. If you require your ticket to be transferred to someone else, please email their full name and email address to info@sevayoga.com.au no less than 3 working days prior to the event.

9.2 Event: Seva Yoga reserves the right to change the event at any time, this includes location. In the unlikely event that this will happen, every effort will be made to ensure an event of equivalent standard in a reasonable distance from the original location.

9.3 Behaviour: Seva Yoga reserves the right to prohibit entry or eject any person from the Venue based on behaviour deemed inappropriate by Seva Yoga staff and/or its agents and others working under its authority.

9.4 Image Release: In registering for Supriya Roy’s programs, you grant permission to Seva Yoga, its agents and others working under its authority, to take and to have full and free use of video/photographs containing your image/likeness. You understand these images may be used for promotional, news, online/multimedia, research and/or educational purposes by and for Seva Yoga. You agree that you are not entitled to remuneration, residuals, royalties or any other payment in respect of your image/likeness or its use. You release, discharge, and hold harmless, Seva Yoga and its agents from any and all claims, demands or causes of actions that you may hereafter have by reason of anything contained in the photographs or video. If you do not agree to the above image release, you must advise Seva Yoga by email as soon as possible at info@sevayoga.com.au

10 Use of Cookies And Pixels

10.1 Similar to other commercial websites, our website utilizes a standard technology called “cookies” and server logs to collect information about how our site is used. Information gathered through cookies and server logs may include the date and time of visits, the pages viewed, time spent at our site, and the websites visited just before and just after our own, as well as your IP address.

A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a website, that site’s computer asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. Seva Yoga reserves the right to use technological equivalents of cookies, including social media pixels. These pixels allow social media sites to track visitors to outside websites so as to tailor advertising messages users see while visiting that social media website. The Company reserves the right to use these pixels in compliance with the policies of the various social media sites.​

Some content or applications, including advertisements, on the Website are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our website. They may use this information to provide you with interest-based (behavioural) advertising or other targeted content.

11 Email Information

If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received online, mail, and telephone. This also applies when you register for our website, sign up through any of our forms using your email address or make a purchase on this site. For further information see the email policies below.

Email Policies

We are committed to keeping your e-mail address confidential. We do not sell, rent, or lease our subscription lists to third parties, and will not disclose your email address to any third parties except as allowed in the section titled Disclosure of Your Information.

We will maintain the information you send via e-mail in accordance with applicable federal law.

In compliance with the CAN-SPAM Act, all e-mails sent from our organization will clearly state who the e-mail is from and provide clear information on how to contact the sender. In addition, all e-mail messages will also contain concise information on how to remove yourself from our mailing list so that you receive no further e-mail communication from us.

Our emails provide users the opportunity to opt-out of receiving communications from us and our partners by reading the unsubscribe instructions located at the bottom of any e-mail they receive from us at anytime.

Users who no longer wish to receive our newsletter or promotional materials may opt-out of receiving these communications by clicking on the unsubscribe link in the e-mail.

12 How and Why We Collect Information

Seva Yoga collects your information in order to record and support your participation in the activities you select. If you register to download resources, sign up for our newsletter, and/or purchase a product from us, we collect your information. We use this information to track your preferences and to keep you informed about the products and services you have selected to receive and any related products and/or services. As a visitor to this Website, you can engage in most activities without providing any personal information. It is only when you seek to download resources and/or register for services that you are required to provide information.

If you are outside the European Union and opt to receive any free resources, participate in any free training programs, register for a webinar, register for a live event, register for a seminar, or purchase any products sold by the Company on this Website, we will automatically enroll ​you to receive our free email newsletter. If you do not wish to receive this newsletter, you can unsubscribe anytime. We include an “unsubscribe” link at the bottom of every email we send. If you ever have trouble unsubscribing, you can send an email to info@sevayoga.com.au requesting to unsubscribe from future emails.

13 How Do We Protect Your Information and Secure Information Transmissions?

We employ commercially reasonable methods to ensure the security of the information you provide to us and the information we collect automatically. This includes using standard security protocols and working only with reputable third-party vendors.

Email is not recognized as a secure medium of communication. For this reason, we request that you do not send private information to us by email. However, doing so is allowed, but at your own risk. Some of the information you may enter on our website may be transmitted securely via a secure medium known as Secure Sockets Layer, or SSL. Credit Card information and other sensitive information is never transmitted via email.

Seva Yoga may use software programs to create summary statistics, which are used for such purposes as assessing the number of visitors to the different sections of our site, what information is of most and least interest, determining technical design specifications, and identifying system performance or problem areas.

For site security purposes and to ensure that this service remains available to all users, the site uses software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

14 Policy Changes

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Website home page. The date the privacy policy was last revised is identified at the bottom of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this privacy policy to check for any changes.

15 Visitors’ GDPR Rights

If you are within the European Union, you are entitled to certain information and have certain rights under the General Data Protection Regulation. Those rights include:

We will retain any information you choose to provide to us until the earlier of: (a) you asking us to delete the information, (b) our decision to cease using our existing data providers, or (c) Seva Yoga decides that the value in retaining the data is outweighed by the costs of retaining it.

You have the right to request access to your data that the Company stores and the rights to either rectify or erase your personal data.

You have the right to seek restrictions on the processing of your data.

You have the right to object to the processing of your data and the right to the portability of your data.

To the extent that you provided consent to the Company’s processing of your personal data, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing based upon consent that occurred prior to your withdrawal of consent.

You have the right to lodge a complaint with a supervisory authority that has jurisdiction over issues related to the General Data Protection Regulation.

We require only the information that is reasonably required to enter into a contract with you. We will not require you to provide consent for any unnecessary processing as a condition of entering into a contract with us.

16 Course Materials, Access and Assessment

  1. Course Materials are supplied in an online environment, unless otherwise stated in the course description, and are available for viewing online and may not be downloaded or printed, unless otherwise specified.
  2. The content of the online Course Materials, including copyright and all other such intellectual property rights contained therein, remain the property of Supriya Roy and Seva Yoga. You may not reproduce any part of the online Course Materials without our prior written consent.
  3. Course materials, course content and assessment are subject to change;
  4. Course duration/study hours are estimates only;
  5. Course materials are provided online via our Learning Management System (LMS) 24/7 or via alternative means. Course materials comprise of written materials, web presentations, videos (where specified) and other learning resources. The eLearning site may occasionally be unavailable during scheduled maintenance. In the event that our eLearning system becomes unavailable, course materials will be provided by another mode of delivery;
  6. Independent research beyond the course materials may be required to complete the assessment. Tutor support is available to help guide students through the course content and assessment only. Tutor support is provided via email and eLearning environment.
  7. All assessments must be submitted online via the eLearning system or as instructed by your Trainer;
  8. ELearning access may be suspended after six (6) months of inactivity; and
  9. Twelve Lifetime course materials access, with extensions available upon application (fees apply).

 

17 Complaints Handling

Any complaint of breach of privacy may be made via email to info@sevayoga.com.au. We will use our best efforts to respond to any complaint within 10 business days of the date of receipt. We will attempt to resolve your complaint to your satisfaction. If you are not satisfied with how we deal with your complaint you may contact the Australian Information Commissioner, whose contact details can be found at http://www.oaic.gov.au/.

 

18 LIMITATION ON LIABILITY

18.1 When you acquire services from us, the Part 3-2, Division 1 of the Australian Consumer Law implies a number of guarantees that cannot be excluded. Subject to the Australian Consumer Law, to the full extent permitted by law:

(a) under no circumstances (including but not limited to any act or omission on the part of us) will we be liable for any indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use of or access to, or any inability to use or access, the Website;

(b) we exclude all guarantees, conditions, warranties and terms implied by statute, general law or custom.

18.2 For the avoidance of doubt, nothing in these Terms limits or restricts your ability to make a claim that may be available to you for our failure to comply with a guarantee under the Australian Consumer Law.

 

19 DISCLAIMER

By joining in a Seva Yoga and Supriya Roy’s courses and trainings online or in person you agree to the following terms:

We provide a nurturing and safe practice with general guidelines for the practice, taking care & our lessons are thoughtfully planned, but no responsibility will be taken for any injuries you may incur during this practice.

Consult your doctor if you have any pre-existing medical conditions and check if this practice is suitable for you.

It is essential that you retain full responsibility for your own physical and general well-being in applying instructions in this guided program to your own circumstances.

The golden rule is ‘if it doesn’t feel right then don’t do it’. We encourage you to stop when you need to. Feel free to ask for assistance after the class. We are here to help you get the most from your practice and more than happy to offer adjustments or alternatives.

Seva Yoga and Supriya Roy will not accept liability for any injury or otherwise from your participation in this program. As is the case with any physical activity, the risk of injury is always present and cannot be entirely eliminated. If you experience any pain or discomfort you agree to listen to your body, adjust the posture or stop all together. You affirm that you alone are responsible to decide whether to practice yoga.

Take care of yourself and reap the benefits. Practice deepening your awareness and understanding of your body and your Self. Enjoy.

20 Student Obligations

Students at Seva Yoga are required to:

  1. Ensure that all the information provided to Seva Yoga is accurate;
  2. Maintain currency of their contact information (email, telephone, address etc.);
  3. Advise us of any difficulties or problems they may experience with instructor, staff, procedures or training via email at info@sevayoga.com.au or the Seva Members Group on Facebook;
  4. Achieve satisfactory progress with their studies through participation and completion of assessments. Students are able to submit an assignment for marking three (3) times. If a student fails to attain a Competency Achieved/Pass grade upon the third attempt, re-enrolment into the unit will be required – charges will apply; and
  5. NOT submit or claim as their own, work derived from other source or work completed by another person. Students found copying and pasting content directly from the Internet will be in breach of these terms and conditions and enrolment in the unit will be cancelled. Re-enrolment will be required – charges will apply.
  6. In your interaction with administrative staff and tutor (including, but not limited to telephone calls, emails and instant chats) you agree to conduct yourself civilly and respectfully at all times. As a customer or student of Seva Yoga, you agree that you shall not, under any circumstances, use abusive language or harass staff. Seva Yoga reserves the right to determine, at its sole discretion, what constitutes abusive language and harassment, and where that has occurred; and may, partially or completely, deny service to any infringing party.
